This Return and Refund Policy (“Policy”) governs the terms under which purchases are made from Professional Templates (Pty) Ltd (“Company,” “we,” “our,” or “us”) via our website, platforms, or other authorised distribution channels (collectively the “Website”). This Policy forms part of and must be read in conjunction with our Terms and Conditions of Sale. By purchasing or downloading any digital product, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agreed to the provisions of this Policy.
1. Nature of Our Products
1.1 All products offered for sale on the Website are digital legal templates in the form of downloadable files.
1.2 Due to their nature, once a digital template has been purchased and delivered to the Customer, it is deemed to be consumed. Delivery occurs immediately at the point of sale by granting download access, whether or not the Customer subsequently accesses or downloads the file.
2. No Returns or Exchanges
2.1 All sales are final. Owing to the digital format of our products, we strictly do not accept any returns, cancellations, or exchanges once a purchase has been completed and access to the product has been granted.
2.2 Customers are therefore advised to carefully review product descriptions, features, and intended use before placing an order. If clarification is required, Customers are encouraged to contact us at talk@professionaltemplates.co.za prior to purchase.
3. No Refunds
3.1 The Company does not issue refunds under any circumstances once a product has been purchased and delivered.
3.2 This includes (but is not limited to):
- Change of mind after purchase.
- Incorrect product choice by the Customer.
- Perceived lack of suitability for the Customer’s specific circumstances.
- Failure to download or use the template after purchase.
3.3 Refunds will only be considered in the narrow and exceptional case where: - A duplicate transaction has been processed by error on our part; or
- A technical fault on our system has prevented delivery of the purchased file(s), provided that such fault is verified by the Company’s support team.
4. Technical Support and Delivery Issues
4.1 In the event of any technical issues accessing or downloading a purchased template, the Customer must notify the Company within 7 (seven) days of purchase.
4.2 Upon verification, the Company will take all reasonable steps to ensure that the Customer receives the purchased product, including re-issuing download links or sending files directly.
4.3 Such remedial action shall not be construed as a refund, return, or exchange.
5. Intellectual Property and Licensing
5.1 All templates sold remain the intellectual property of the Company. Purchase grants the Customer a non-exclusive, non-transferable license to use the template for personal or business purposes in accordance with our Terms and Conditions.
5.2 Unauthorised sharing, resale, reproduction, or redistribution of purchased templates is strictly prohibited and may result in legal action.
6. Limitation of Liability
6.1 The Company provides templates on an “as-is” basis, without warranties as to fitness for a particular purpose, completeness, or applicability to the Customer’s unique legal or business circumstances.
6.2 The Customer acknowledges that templates are generic in nature and do not constitute legal advice. The Company shall not be held liable for any loss, damage, or claim arising from the Customer’s use, misuse, or modification of the product.
7. Governing Law and Jurisdiction
7.1 This Policy shall be governed by and construed in accordance with the laws of the Republic of South Africa.
7.2 Any dispute arising under or in connection with this Policy shall fall within the exclusive jurisdiction of the Durban Magistrates’ Court, to the exclusion of any other forum.
8. Amendments
8.1 The Company reserves the right to amend this Policy at any time. Updates shall become effective immediately upon publication on the Website.
8.2 Customers are advised to review this Policy periodically. Continued use of the Website or purchase of products following such amendments shall constitute acceptance thereof.
